Nursing Home Abuse

Americans are living longer. With advances in medicine, the life expectancy for an average American is now 78 years of age. So it only makes sense that more and more people are living in nursing homes as the elder population grows. And, even with the additional people at these nursing homes, it is important that the care that one receives does not suffer.

Unfortunately, when a loved one is in a nursing home that loved one does not always receive the best of care. Sometimes there is abuse or neglect. Bruises, bedsores, open wounds, fleas and lice, sudden weight loss, fecal/urine odors and general poor hygiene are some of the most common examples. There are also nonphysical injuries such as intentional infliction of emotional distress and psychological harm that can also be just as serious. If you have a friend or loved one that has been involved in a nursing home accident, you should contact the lawyers at the Law Offices of Andrew S. Alitowski.

The elderly do have protection. The State of Kentucky has enacted thorough and demanding laws to prevent nursing home abuse. So too has Medicare and Medicaid and the Federal government. Kentucky has passed the Kentucky Nursing Home Reform Act. This bill gives residents in part a right to privacy, adequate health care and freedom from corporal abuse. The Kentucky state laws allow for civil lawsuits to be brought against a facility that has been found guilty of abuse of its residents.
