Usually when employment discrimination occurs it is by either a supervisor or coworker. Employment discrimination usually takes the form of harassment such as ethnic slurs or any other verbal or physical conduct directed toward any racial, ethnic, or religious group which is prohibited.

Title VII of the Civil Rights Act of 1964 prohibits an employer to discriminate in an employment setting on the basis of one’s race, color, religion, sex, national origin, age, disability or marital status. An employee or an applicant for employment may file a complaint when: a) the alleged discrimination act occurred within the past 365 days and 2) an employer or potential employer has 15 or more employees. Kentucky has a similar state statute entitled the Kentucky Civil Rights Act. And also, there are separate state statutes that protect a person from being discriminated against for having HIV, Aids or black lung disease.
